Version 1.0. The version in force when you place an order applies to that order.
Important terms — please read these first. Some clauses below limit our responsibility, place risks or duties on you, or ask you to confirm facts. We have collected them here so you see them before you order:
- Our responsibility for loss. Clause 10 limits what we are responsible for. If you buy as a business, it also caps our liability at the price of your order. It does not limit any right that the law says cannot be limited.
- Risk passes to you on delivery. See clause 7.
- We ship DAP (Incoterms® 2020), and you are the importer. Import duties, taxes and customs clearance are the buyer’s responsibility, unless otherwise specified on the invoice. See clauses 4 and 7.
- Change-of-mind returns. You prepay the return freight, and delivery and other secondary charges are not refunded, except where the law says otherwise. See clause 8.
- Charges if you cancel or return by choice. If you cancel before dispatch, or return the sauna because you changed your mind, we may charge our reasonable costs, never more than 20% of the price. These charges never apply where the law gives you a free right to cancel. See clause 8.
- Safe use is your responsibility. You must use the sauna as the manual and our safety page say, on two dedicated wall sockets, with no extension leads. If you use it in a business, you are responsible for screening and supervising your clients, and you cover us against claims that arise from how you run your sessions. See clause 3.
- Only pay into Salvagente’s own bank account. We never change our bank details by email. We are not responsible for money paid into any other account, unless our negligence caused it. See clause 6.
- Business Support Benefits. If you join as an Affiliated Outlet, you take on duties to us, and we may change or withdraw the benefits. See clause 14.
1. Who we are
The seller for every order on salvagente.co is Salvagente Pty Ltd (“Salvagente”, “we”, “us”), a private company registered in South Africa, registration number 2007/023919/07.
- Physical address, and address for service of legal documents: Menlyn Maine, Pegasus Building 1, 210 Amarand Avenue, Waterkloof Glen ext 2, Pretoria, 0181
- Email: info@salvagente.co.za · Phone: +27 (0) 72 422 1967 · Website: salvagente.co
- We do not belong to any self-regulatory or accreditation body, and we do not subscribe to any code of conduct.
2. Which terms apply to you
salvagente.co has three sections:
- /za/ for delivery in South Africa;
- /au/ for delivery in Australia;
- / for delivery everywhere else.
The section you order from sets your prices, your payment options and the parts of these terms that apply to it. Orders for delivery in South Africa are always handled in the /za/ section.
These terms, our Returns policy and our Two-Year Limited Warranty form your contract with us. Our Privacy notice explains how we handle your information. It is a notice, not something you agree to.
Some rights apply only if you buy as a consumer (for your own private use), not as a business. Where that matters, these terms say so. If you buy for a business, you confirm that you have authority to bind that business. Nothing in these terms removes or limits any right you have under a consumer law that cannot be excluded.
3. Our products, and using them safely
- What we sell. Our saunas are wellness equipment. They are not medical devices, and we do not claim that they prevent, treat or cure any illness or condition. If you have a medical condition, are pregnant or take medication, ask your doctor before using a sauna.
- Descriptions and pictures. We work to keep descriptions, specifications and prices accurate. Pictures are illustrations and can differ slightly from the product, for example in how a colour looks on your screen. If we find a material error in what you ordered before we dispatch it, we will tell you. You can then confirm the order, or cancel it for a full refund.
- Setting it up. The sauna arrives assembled on castors. It needs two dedicated wall sockets, one for the sauna and one for the oxygen concentrator. Do not use extension leads. You must follow the operating manual and our safety page.
Business use. If you use the sauna in a business, you are responsible for:
- screening your clients before a session;
- having a trained person present and within call during every session;
- following the manual and our safety page;
- holding any licence, permit or insurance your business needs;
- what you and your staff tell clients about the sauna.
Claims by your clients. If you use the sauna in a business, you are responsible for, and you indemnify us (meaning you cover our loss and costs) against, any claim by your clients or staff that arises from how you run your business or sessions, such as skipped screening, missing supervision or not following the manual. This does not apply to the extent that the loss was caused by a defect in the sauna or by our negligence.
Training. We supply the operating manual and training videos for your model, and after-sales support by email and phone.
4. Prices
- Prices are in US dollars.
- We ship DAP (Incoterms® 2020). Import duties, taxes and customs clearance are the buyer’s responsibility, unless otherwise specified on the invoice. Our prices do not include them. You are the importer, and you pay these charges to the carrier or the customs authority before delivery. Charges paid to the carrier or a customs authority are not payments to us, and we do not refund them.
- Any delivery charge is shown at checkout, before you place your order.
- The price at checkout is the price you pay. We will not raise it after you have ordered.
- Obvious errors. If a price is obviously wrong (for example, a typing error puts it far below the real price) and you could reasonably have seen that, we may cancel the order before dispatch and refund everything you have paid.
5. Ordering, and when the contract is formed
- Before you place your order, the checkout shows the whole order. You can correct any mistakes, or leave without ordering.
- When the contract starts. Placing an order is an offer to buy. A contract forms when we email you our order confirmation.
Declining or cancelling an order. We may decline any order before we confirm it. After we confirm it, we may cancel it if:
- we cannot deliver to the address you gave;
- we reasonably suspect fraud;
- clause 4’s obvious-error rule applies;
- payment does not arrive in time (clause 6); or
- an event outside our control prevents us from supplying it (clause 10).
If we decline or cancel, we refund everything you have paid.
Keeping a record. We email you the details of your order. You can print or save these terms at any time. Earlier versions are available on request.
6. Payment
Bank transfer (all sections).
- After you place your order, we email our bank details and your order number. They also appear on your order confirmation page.
- You pay into our South African multi-currency account (USD, GBP or EUR).
- Every account we use is in the name of Salvagente Pty Ltd.
- We will never change our bank details by email. Before you pay, call us on +27 (0) 72 422 1967 to confirm them. If anyone asks you to pay into a different account, do not pay. Call us.
- We are not responsible for money paid into any account other than ours, unless our negligence caused it. A payment into another account is not a payment to us.
- We hold your order for 7 days while payment clears. If the full amount has not arrived by then, we cancel the order and nothing is owed.
- Your own bank’s charges are yours to pay.
Card payment.
- Card payments are received by Memutar Inc, 651 North Broad Street, Middletown, DE 19709, USA (EIN 35-2716635), the contracted processing company facilitating payments on behalf of Salvagente.
- Your contract of sale is with Salvagente Pty Ltd, not with Memutar.
- Cards are processed by Stripe. Your card number goes straight to Stripe; we never see or store it.
- Your card statement will show theBooking.site. Your contract of sale is still with Salvagente Pty Ltd.
- Card refunds go back to the card you paid with.
We dispatch only once we have received full payment.
7. Delivery
Lead time.
- Most saunas are built to order and usually ship within a week of our order confirmation (an estimate, based on current orders). After dispatch, air freight takes 7–10 days and sea freight 10–12 weeks.
- If we expect a delay, we will tell you.
Delivery. We deliver by door-to-door courier to the address you give us, unless your invoice says otherwise. You are responsible for making sure the sauna can be delivered to that address and moved to its room. It is large and heavy.
Import terms.
- We ship DAP (Incoterms® 2020) to the address you give us, unless otherwise specified on the invoice. We arrange and pay for carriage to that address, and the sauna is at our risk until it arrives.
- You are the importer of record. Import duties, taxes and customs clearance are the buyer’s responsibility, unless otherwise specified on the invoice. You clear customs and pay all import charges (clause 4).
- Where these terms and the DAP rule differ, these terms apply. Risk and ownership pass as set out below.
- If the sauna comes back to us because import charges were not paid or the delivery was refused, we refund what you paid, less the actual return carriage and charges we incurred.
When it arrives.
- You must check the sauna on delivery, and note any damage or missing items on the carrier’s delivery document.
- If that is not possible, email us with photos within 2 business days.
- We need this to claim from the carrier. It does not limit your legal rights.
Delays caused by you. If you ask us to delay delivery, or a delivery fails for a reason within your control, we may charge reasonable, documented storage or redelivery costs. We only charge after we have held the sauna for 10 business days.
Risk and ownership. Risk passes to you when the sauna is delivered to you, or to the person you nominate. Ownership passes when we have received full payment.
8. Cancelling and returns
- Before dispatch. You may cancel at any time before we dispatch your sauna. We refund what you have paid, less any cancellation charge below.
- Why a cancellation may carry a charge. Our buyers come to us. We don’t cold-call or sell door to door. You have time to research, to ask us for a written quote, and to decide before you order, so order only once you are sure. Most saunas are built to order, and on the Red Light the colours and accents are customised for you. Once we confirm your order, we commit costs to it: we allocate your sauna, book freight and order any special parts. That is why cancelling after our confirmation may carry the charge below. It never applies where the law gives you a free right to cancel.
- Cancellation charge. If you cancel after our order confirmation and before dispatch, we may charge the reasonable costs your cancellation causes us, such as payment and bank charges, freight already booked, and parts or work ordered for a special requirement. It is never more than 20% of the order price. We tell you the amount and how we worked it out, and deduct it from your refund; if you have paid nothing, we don’t charge it.
- The cancellation charge does not apply if you are a consumer in the EU or UK withdrawing within 14 days.
- The cancellation charge does not apply if you cancel because we are late, made an error, or for any other reason the law lets you cancel free of charge.
- After delivery. You have 14 days after delivery to return the sauna. You prepay the return freight. On a change-of-mind return we refund the price of the sauna, but not delivery, optional extras, special requirements or import charges. A handling charge may apply. See our Returns policy.
- If you are a consumer in the EU or UK, you also have the 14-day right of withdrawal, on the terms set out in our Returns policy.
Your legal rights are not affected.
9. Warranty and your legal rights
Every new sauna comes with our Two-Year Limited Warranty.
Outside South Africa, you also receive a complimentary set of critical spare parts, sent with your sauna.
Your legal rights are not affected.
- If you are a consumer in the EU or UK, you have legal rights if the goods do not conform to the contract. Our warranty does not affect them. If you are in the United States, the warranty is a “Limited Warranty” under the Magnuson-Moss Warranty Act.
10. Our responsibility for loss or damage
What we never limit. Nothing in these terms excludes or limits our liability for:
- death or personal injury caused by our negligence;
- our gross negligence, wilful misconduct or fraud;
- defective or unsafe products under product-liability law;
- any other liability that the law does not let us limit.
If you are a consumer. We are not responsible for any loss that was not a foreseeable result of our breaking these terms or of our negligence.
If you buy as a business (subject to “What we never limit” above, and as far as the law allows):
- we are not liable for loss of profit, revenue, business or goodwill, or for indirect or consequential loss;
- we are not liable for loss that arises from how you run your business or sessions (clause 3);
- our total liability for an order is limited to the price paid for that order; and
- you confirm that you chose the sauna on your own assessment, relying only on these terms, our published product information and any written quote from us, and not on any other statement.
Events outside our control. We are not responsible for delays or failures caused by events outside our reasonable control, such as carrier or port disruption, natural events or power outages. We will tell you. If the delay goes beyond 30 days, either of us may cancel the order, and we refund what you have paid for goods not delivered.
11. Using our website
You must not:
- copy, scrape or harvest our listings, descriptions, prices or any other content, by any means;
- try to gain unauthorised access to the site or our systems;
- put an unreasonable load on the site, or interfere with how it works;
- reverse-engineer the site;
- use the site for any unlawful purpose.
We may suspend or block access for anyone who breaks this clause, and we will take legal action where needed.
If you create an account, keep your password private, and tell us straight away if you think someone else has used it.
Our outlets page includes Google Maps features and content. Your use of them is subject to the then-current Google Maps End User Additional Terms of Service (https://maps.google.com/help/terms_maps/) and the Google Privacy Policy (https://policies.google.com/privacy).
12. Intellectual property
All content on this website belongs to Salvagente or its licensors and is protected by copyright. This includes text, pictures, illustrations, drawings, video, manuals and the design of the site.
- You may view the site, and print or save pages (including these terms), for your own personal, non-commercial use.
- Any other copying, reproduction, distribution, publication, adaptation or recreation of our content, in whole or in part, without Salvagente’s express written consent, is unauthorised. Unauthorised use infringes our copyright and is prohibited.
- You must not use the Salvagente name, logo or content in a way that suggests a connection with us or our endorsement, without our written consent.
- We protect our intellectual property and will enforce our rights against any infringement, including by seeking an interdict or injunction, damages and our legal costs.
If you believe something on our site infringes your rights, email info@salvagente.co.za with the details, and we will review it promptly.
13. Other businesses we mention
- theBooking.site is run by its own company, theBooking.site. It is not part of this contract. Its fees and terms are set by theBooking.site: see thebooking.site/terms-and-conditions (opens in a new tab).
- Outlets. Outlets shown on our site are independent businesses. They are responsible for their own services, and we are not responsible for their services, prices or conduct. Outlets in our Business Support Benefits programme are also bound by clause 14.
14. Business Support Benefits
This clause applies only to business buyers who join our Business Support Benefits programme. It does not apply to consumers.
Who it is for. If you buy a sauna from us for professional use, you may ask to join. We decide who joins. A business we accept is an “Affiliated Outlet”.
The benefits. Business support for clinic buyers is included at no charge. Some optional services carry a fee.
- The benefits are those listed on our website at the time, unless we agree otherwise in writing.
- The benefits are not part of the goods you buy. The price of your sauna is the same whether or not you take them up.
- Fees for optional services. Before we provide a service that carries a fee, we tell you the fee in writing. You pay it only if you ask us to go ahead. Fees are payable as agreed and are not refunded once the service has been provided.
- No promised results. We do not promise any number of enquiries, bookings, clients or sales from any benefit.
- Services from other businesses. Some benefits are provided by other businesses, such as theBooking.site, on their own terms and fees (clause 13).
- Your listing. We list your outlet on our website and in our materials only with your consent under our outlet listing agreement. You may withdraw that consent at any time by emailing info@salvagente.co.za, and we remove the listing within 7 days.
Your obligations as an Affiliated Outlet. In return for the benefits, you must:
- run every session as clause 3, the operating manual and our safety page require;
- when we refer to you someone who is considering buying a Salvagente sauna, offer them one ozone session at no charge, at a time that suits you both. We pass on a person’s details only with their agreement. You may decline or stop a session if your screening shows it is not suitable for that person;
- refer to us any of your clients who wants to buy an ozone sauna. We pay a referral commission only where we have agreed it with you in writing;
- promote the Salvagente products and services we agree with you in writing, to the best of your ability. You set your own prices;
- make no claim that a Salvagente sauna, or ozone, prevents, treats or cures any illness or condition, and use our marketing material only as we supply it;
- use our name, logo and content only as we allow in writing, and stop using them when your benefits end;
- tell us promptly about any complaint, incident or injury involving a Salvagente sauna at your outlet;
- handle your own clients’ personal and health information lawfully. The intake and consent forms you use, and the records you keep, are your responsibility, not ours.
Changing or withdrawing the benefits.
- We may change, add to, reduce or withdraw any benefit, for all Affiliated Outlets or for you, at our discretion. We will give you reasonable notice where we can.
- We may suspend or end your benefits straight away, by notice to you, if you break this clause or these terms, infringe our intellectual property, make a claim this clause prohibits, run sessions unsafely, act in a way that damages or is likely to damage Salvagente’s name or reputation, fail to pay an amount you owe us, or become insolvent.
- Your benefits end if you return the sauna, or if the sale is cancelled.
- Changing, suspending or ending a benefit does not entitle you to a refund, discount or compensation. It does not affect your sauna, its warranty or the rest of these terms.
- You may leave the programme at any time by telling us in writing.
Our relationship. You are an independent business. You are not our agent, partner, employee or franchisee, and you may not make any commitment on our behalf. The benefits are personal to you and cannot be transferred.
15. If an order is not paid, or these terms are broken
- If payment does not arrive within the hold period, the order is cancelled (clause 6).
- If either of us seriously breaks these terms, the other may cancel any order not yet delivered. Any payment for goods not delivered is refunded. Each of us keeps any right to claim for loss caused by the other’s breach.
- If you buy as a business and we have to take legal steps to recover money you owe us, you pay our reasonable legal and collection costs.
- If we do not enforce a right straight away, or we allow you extra time, we have not given up that right.
- If part of these terms can’t be enforced. If a court or regulator decides that a clause, or part of one, is unenforceable, it is limited or removed only as far as needed, and the rest of these terms stays in full force.
16. Transferring the contract
- You. You may transfer your rights under an order only with our written consent, which we will not unreasonably refuse. Our warranty covers the first owner only (see the warranty page). A later owner keeps any rights the law gives them.
- Us. We may transfer our rights and duties to another business that will honour them. We will tell you. If you are a consumer and unhappy with the transfer, you may cancel any order not yet delivered for a full refund.
17. Law and disputes
Governing law. South African law governs these terms. This does not take away the protection of mandatory consumer laws in the country where you live.
Contact us first. Before starting court or arbitration proceedings about an order, you must first set out your complaint to us in writing, with your order number, and give us 10 business days to respond and try to resolve it. This step does not apply to urgent applications. We reply within 10 business days.
If you buy as a business, the courts of South Africa have exclusive jurisdiction.
18. Changes to these terms
We may update these terms. The date at the top shows the current version. The version in force when you placed your order applies to that order.
If you ordered before this version took effect, the version in force on the day you ordered still applies to that order, including its warranty and returns terms. A new version does not cancel or change the terms of an earlier order unless you agree in writing.
